These Terms of Service (“Terms”) govern your use of the Visual Web Solutions website at visualwebsolutions.ca (the “Site”) and any services provided by Visual Web Solutions (“VWS”, “we”, “our”, “us”). By accessing or using this Site, you agree to be bound by these Terms.
1. Services
Visual Web Solutions provides web development, search engine optimization, generative engine optimization, and AI and automation services for professional service firms and businesses. The specific scope, deliverables, timeline, and fees for any engagement are defined in a separate written agreement or proposal between VWS and the client.
Nothing on this Site constitutes a binding offer or contract. All engagements require a signed agreement before work begins.
2. Use of This Site
You may use this Site for lawful purposes only. You agree not to use this Site in any way that could damage, disable, or impair the Site or interfere with any other party’s use of the Site. You may not attempt to gain unauthorized access to any part of the Site, its servers, or any systems connected to the Site.
3. Intellectual Property
All content on this Site – including text, graphics, logos, images, design elements, and code – is the property of Visual Web Solutions or its licensors and is protected by Canadian and international copyright, trademark, and intellectual property laws.

4. Client Work and Ownership
Ownership of deliverables, intellectual property rights, licensing terms, and usage rights for any client engagement are defined in the individual project agreement between VWS and the client. These Terms do not supersede or modify any provisions in a signed client agreement.
5. Third-Party Tools and Services
Our services may involve the use of third-party platforms, tools, and services including but not limited to WordPress, Google, Semrush, Rank Math, Make, OpenAI, and WooCommerce. VWS is not responsible for the terms, policies, availability, or performance of any third-party service. Your use of any third-party platform is subject to that platform’s own terms and conditions.
6. No Guarantees
While we strive to deliver measurable results for our clients, VWS does not guarantee specific outcomes including but not limited to search engine rankings, AI citation placement, lead generation volumes, or revenue increases. Search engine algorithms, AI model behavior, and market conditions are outside our control and subject to change.
Any case studies, testimonials, or results referenced on this Site reflect the specific circumstances of those engagements and should not be interpreted as a guarantee of similar outcomes.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Visual Web Solutions and its owner, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this Site or any services provided by VWS.
Our total liability for any claim arising from these Terms or your use of this Site shall not exceed the amount you paid to VWS in the twelve months preceding the claim, or one hundred Canadian dollars (CAD $100), whichever is greater.
8. Indemnification
You agree to indemnify and hold harmless Visual Web Solutions, its owner, employees, and contractors from any claims, damages, losses, or expenses (including legal fees) arising from your use of this Site, your violation of these Terms, or your violation of any third party’s rights.
